General terms and conditions of use

The purpose of these General Terms and Conditions is to define the terms and conditions for using the services made available on the www.mediafinance.ma website, hereafter referred to as ‘the Service’ and the general terms and conditions of use of this Service by the User.

Any access and/or use of the www.mediafinance.ma website and its sub-sites shall imply acceptance and compliance with each term stipulated in these Conditions and their unconditional acceptance. They shall therefore constitute a contract between the Mediafinance and the User.

Should the User not wish to accept all or part of these general terms and conditions, he or she is requested to not use the Service.

Definitions

User: A User is any person who uses the website or any of the services made available on the website.

User Content: The term ‘User Content’ refers to the data conveyed by the User in the different sections of the website.

Member: The term ‘Member’ refers to an identified user on the website.

Username: The term ‘Username’ refers to the information needed to identify a user on the website so as to be able to access member areas.

Password: The term ‘Password’ refers to confidential information which the User must keep secret, enabling him or her, used in conjunction with his Username, to prove his or her identity.

Processing personal data

The purpose of processing and recording the information collected by Mediafinance, as data controller, via the forms on the www.gbp.ma website and its sub-sites, e-mail or sales promotions (games, contests, etc.), is:

  • To manage recruitment procedures

This information is solely intended for use by Mediafinance, if applicable. It will not under any circumstance be made available to third parties.

Users’ contact details are used for communication purposes only to convey to them the information that they have asked to receive and possibly information relating to offers of Mediafinance’s products and services.

Personal data are protected by a duty of professional confidentiality with which Mediafinance complies.

Personal data may be conveyed to official bodies and administrative or judicial authorities if they so request.

The period of time during which Mediafinance, as data controller, may retain this personal information shall comply with the prevailing regulations.

Pursuant to Act No. 09-08, decreed by Dahir 1-09-15 of 18 February 2009, relating to the protection of individuals with regard to the processing of their personal data, you are entitled to access, correct or object to the processing of information which relates to you. This letter must specify the method of request that has been refused. You may also refuse to participate in surveys or opinion polls by writing to the same address. The CNDP has been informed of and has authorised your personal data to be processed which has been acknowledged by receipt No. XXX.

The www.gbp.ma is a website relating to Mediafinance, its products and services.

Mediafinance cannot guarantee, however, that this information is accurate or relevant. Furthermore, the information provided on this website is for information purposes only and cannot constitute any advice or recommendation whatsoever.

Consequently, Mediafinance cannot under any circumstance be held responsible for the manner in which the information and contents available on the entire website are used. The User is solely responsible for using the information made available to him or her on the website in a proper and intelligent manner.

The User shall also agree to compensate Mediafinance for any damaging consequences directly or indirectly related to its use of the Service.

Access to certain sections of the www.gbp.ma website requires the use of a Username and Password. The Password, chosen by the user, is personal and confidential. The User shall agree to keep his password secret and to not disclose it in any form whatsoever. Online use of his or her Username and Password is at the User's own risk. It is the User's responsibility to take all necessary measures to protect his or her own data against any breach.

Mediafinance shall undertake, however, to put in place all necessary means to guarantee the security and confidentiality of the data collected. The User is informed that one or more cookies, which do not contain any personal information, may be downloaded onto his or her hard disk so as to ensure his or her identity.

The User shall acknowledge the limitations and constraints that are specific to the internet and, as such, shall recognise, in particular, that is it impossible to offer a total guarantee regarding the secure exchange of data. Mediafinance cannot be held liable for damages resulting from the transmission of any information such as the Username and/or Password via the Service.

Mediafinance cannot under any circumstance be held responsible for any type of damage or harm, whether direct or indirect, tangible or intangible, resulting from the Service being unavailable or from any Use of the Service. The term ‘Use’ must be understood in a broad sense, that is to say, any use of the website whatsoever, whether lawful or not.

The User shall undertake, in general, to comply with all the prevailing regulations in Morocco.

Force majeure

Mediafinance cannot be held liable in the event of a force majeure event or an event that is beyond its control.

Amending this contract

Mediafinance shall reserve the right to amend the terms, conditions and references of this contract at any time.

Users are advised to regularly consult the latest version of the General terms and conditions of use which are available at www.mediafinance.ma

Contract’s term and termination

The present contract is concluded for an indefinite period starting from the moment that the User uses the Service.

Applicable law and jurisdiction

The legal rules applicable to the content and transmission of data around and about the website are determined by Moroccan law.

In the event of any dispute which cannot be resolved amicably, Moroccan courts within the jurisdiction of the Court of Appeal of Casablanca are alone competent.​
